ORANGE, Calif. – On Monday night (Sep. 28), a female driver suspected of driving under the influence, was driving when she slammed into a patrol car stopped at a red light.
The Orange police officer was in his patrol car, stopped at a red light near the intersection of East Chapman Avenue and South Yorba Street. It was around 10 p.m. when the female driver plowed into him, according to police.
The crash crushed the driver’s side door; emergency personnel had to pry open the doors of the patrol car to get the officer out. After placing the officer in a neck brace, he was transported to a local hospital. Fortunately, his injuries were reported as moderate.
Dressed in “workout clothes” and appearing as if she had been to the gym, the alleged DUI driver was asked to perform field sobriety tests at the scene of the crash. After failing the tests, the woman was arrested, California Highway Patrol officials said.
The DUI suspect is facing numerous charges, ABC7 reported.
DUI Accidents Causing Bodily Injury
It is not clear as to which charges the alleged DUI driver above is facing, but there is a strong possibility that one of them will be “DUI with injury,” which is covered under California Vehicle Code Section 23153 VC.
DUI with injury is known as a “wobbler” offense, meaning it can be charged as either a misdemeanor or a felony depending on:
- The defendant’s criminal history
- The circumstances of the DUI offense
If charged as a misdemeanor, DUI with injury is punishable by probation, up to one year in jail, up to $5,000 in fines, alcohol or drug education, up to a three year license suspension, and restitution to the injured parties.
As a felony, DUI with injury is punishable by up to four years in prison (or longer for serious bodily injuries), a “strike” on the defendant’s record if anyone was seriously injured, up to $5,000 in fines, DUI school, Habituation Traffic Offender (HTO) status, and a five-year driver’s license revocation.
