Olympic Superstar Arrested for Second DUI in Ten Years

Michael Phelps was arrested on September 30 and charged with driving under the influence, excessive speed, and crossing double yellow lines. His BAC read .14 at the time of his arrest.

Phelps is facing a few punishments from USA Swimming following his DUI arrest, including:

  • Suspension from USA Swimming until April 6, 2015
  • Withdrawal from the August 2015 world swimming championships in Russia
  • 6 month funding loss from USA Swimming totaling $10,500

Aside from breaking the law, Phelps is said to have broken USA Swimming's Code of Conduct and is facing punishments outlined in the 2014 Rule Book. This is the harshest punishment inflicted on the swimmer, as he received no punishment for an underage drunk driving arrest in 2004 and faced a three month suspension when a photo showed him smoking marijuana in 2009.

Phelps entered a six-week, in-patient program following his arrest, and is looking at one year in jail, a $1,000 fine, and the loss of his driver's license if convicted for the DUI. For his first DUI, Phelps pleaded guilty but the charges were dropped after a judge waived the conviction with successful completion of an 18-month probation.

Phelps' case, while a lesson in the serious penalties a DUI conviction can pose, also shows how negatively a conviction can impact one's personal and professional life. Although most of us may not have corporate sponsors, we know that employers can view DUI convictions negatively. In certain professions – including those that require driving a company vehicle and those that have professional licenses (like Doctors) – a conviction can also lead to negative employment consequences.
