Delaware Man Charged With Fifth DUI Since 2007

A Delaware man has accrued five DUI convictions since 2007. The more DUI convictions a person has, the larger the penalties are. Many states have a lookback period, which is a set number of years a court can look back at previous convictions to determine DUI sentencing. Delaware has a lifetime lookback period, meaning that a court can look at all prior DUI arrests.

Man Protests His Arrest, Gets Stunned

The Delaware man was stopped for a traffic violation when officers noticed that his eyes were bloodshot and he smelled of alcohol. The officers asked the man to perform a field sobriety test, which he failed. He was then brought into custody for a blood test.

When at the jail, the man began to yell and curse at the arresting officers and damaged the equipment used to examine blood alcohol levels. The officers were forced to us stun guns to subdue the man.

Multiple DUI Convictions Carry Heavy Consequences

When a person obtains multiple DUI convictions, the penalties increase in severity. For a fifth DUI conviction, the Delaware man faces a class E felony which carries a minimum fine of $3,500 and minimum of 3 years in jail. He may also have an ignition interlock device installed on his car to prevent future incidents. Since Delaware has a lifetime DUI lookback period, any further DUI arrests for the man can result in over $10,000 and up to 15 years of jail time.
