NY Woman Kicks Trooper in Face with High-Heeled Shoes, Charged for DWI

A New York woman has been charged for Driving While Intoxicated (DWI), assault on a police officer, and several other offenses after an altercation broke out during her arrest. In what's made national headlines, the 26-year-old woman from Yonkers had been stopped by NY State Police after she struck a guard rail several times with her vehicle. After questioning her and conducting sobriety tests, officers determined that she was intoxicated and placed her under arrest.

While under arrest and in the back seat of the police car, the woman became upset, loud, and began kicking the interior of the cruiser. State troopers made an attempt to restrain the woman, but during the altercation, one state trooper was kicked in the face by the woman with her high-heeled shoe. According to officials, the trooper suffered serious injuries to his eye.

After the altercation, troopers managed to get the woman under control, and transported her for breath testing. She blew a .16 – twice New York's legal limit of .08. She has been charged for DWI, felony assault on a police officer, resisting arrest, aggravated unlicensed operation of a motor vehicle, and various traffic infractions.

Lesson Learned

This story, while on the extreme side of DWI arrests, may serve as entertainment for the public at large. However, it can also serve as a crucial reminder that one's conduct during the short time of their arrest can lead to serious, life-altering consequences. In this case, the woman now faces a slew of criminal charges. Should she have cooperated and requested a lawyer, she would be facing less charges and would have provided herself and her attorneys with better opportunities for a defense.

The woman's extreme behavior not only creates extra criminal charges – with the threat of additional and severe penalties – but also can be used as further evidence of the woman's intoxication. Prosecutors are likely to latch on to extreme conduct like the woman displayed in their attempts to gain convictions. Our firm continually stresses to clients and non-clients the importance of remaining calm and respectful during arrests, and to exercise one's right to remain silent and request a lawyer.
