OC Bicyclists Struck and Killed By Alleged Drunk Driver Had History of DUIs

On Tuesday April 29th, a 38-year-old Orange County man was struck and killed while riding his bicycle in Dana Point. The driver of the vehicle – a 19-year-old man – was believed to have been driving under the influence of alcohol. While this type of incident isn't exactly rare, the accident is garnering attention because the victim had a history of DUI convictions himself.

On the day before the accident, the victim – Haitham Gamal – pleaded guilty to a January 2013 charge for DUI in Orange County Superior Court. It was his third DUI. Gamal had also pleaded guilty to a misdemeanor public intoxication charge in 2012.

According to attorneys, Gamal had made a concerted effort to change his life and address his problems with alcohol. Prior to the fatal accident, Gamal has completed an intensive 180-day rehabilitation program. After pleading guilty the day before the accident, Gamal was sentenced to five years of probation and 45 days in jail. He arranged to serve 20 days in jail and an additional 45 days of home confinement. Gamal was riding his bicycle as a result of his license suspension.
