DUI and Diabetes

In the United States, countless people struggle with Diabetes. When people have Diabetes, their blood sugar may be too high or too low. In the latter case, the condition is known as Hypoglycemia. What many people do not know is that the symptoms often associated with having too high or too low blood sugar can be mistaken as signs of driving under the influence (DUI).

For example, a person suffering from Diabetes may have altered states of consciousness, slurred speech and enter into a state of Ketosis, which may be accompanied by a certain breath odor. This odor on the breath may smell similar to ethanol (alcohol) and should a diabetic person be pulled over, police may assume the person had been drinking. The person may then be asked to take a breath test which should resolve the question of impairment, but that is not always the case as there may be difficulties differentiating diabetic conditions from the effects of alcohol consumption through the use of breath or blood tests. This means that people with Diabetes may be arrested for DUI and even face criminal charges.

If you are diabetic and have been mistakenly arrested for driving under the influence, you'll want to consult with an Orange County DUI lawyer immediately. There are measures you can take with the assistance of an attorney to contest your DUI charges.

For instance, you could undergo tests to show your blood sugar impacted the results of your blood or breath alcohol test. Or, should your case proceed to trial, a physician could speak on your behalf and inform the jury of how diabetic symptoms may be mistaken as signs of DUI. The important thing to remember is that you have options and can fight your DUI charges.
