Why Your DUI is Worth Fighting

Were you recently arrested for driving under the influence (DUI) in Orange County? Are you worried that it’s hopeless and you’ll have to plead guilty to DUI and walk down the path of shame? Don’t give up so fast – your DUI case is WORTH FIGHTING.

By their nature, DUI cases have many variables; so, there’s no such thing as an open and shut DUI case. Unfortunately, too many DUI defendants mistakenly believe that a DUI arrest equals an automatic conviction – but that’s only if they sit back and do nothing to challenge their charges. What’s the point in accepting the full wrath of the criminal justice system, especially when you may be entitled to a favorable plea deal or a dismissal?

Let’s say you were in an accident: You failed the field sobriety tests, the officer smelled a strong odor of alcohol on your breath, and in the officer’s report, it says you were so drunk you were slurring your words. Even if all of the officer accounts were true, which they typically aren’t, there are still a number of DUI defenses that could be raised and result in reduced, if not dismissed charges.

What if the Odds Are Against Me?

Even if you think the odds are against you, it’s critical that you consult with an experienced DUI lawyer from our firm. It happens all the time: People plead guilty to DUI because they think the evidence against them is overwhelming. We’ll tell you right now, that is rarely the case.

People can be falsely arrested and wrongly accused of DUI without being aware of it. In a DUI case, as in any criminal matter – you don’t know what you don’t know. The state can use your lack of knowledge against you if you don’t receive proper legal advice and representation. It’s our job as DUI attorneys to evaluate the evidence and ask questions, such as:

  • Was the traffic stop legal?
  • Were the field sobriety tests conducted in accordance with federal guidelines?
  • Do you have a medical condition, such as GERD, diabetes, acid reflux or heartburn that would give a false BAC reading?
  • Was the chemical test taken, stored, and analyzed correctly?
  • Was the breath testing device calibrated correctly?
  • Were you a victim of police misconduct?
  • Were you actually the one driving?

While most police officers are good people, we can’t ignore that police misconduct occurs every day. If any aspect of a DUI case is purposely manipulated, or if evidence was fabricated or illegally obtained, it can be suppressed. Depending on the severity of police misconduct, the prosecutor may decide to reduce or dismiss the charges altogether.
