How Long Will a DUI Show on a Background Check?

If you’re convicted of DUI, your life is going to change in many ways. In the short term, you’re looking at fines, community service, AA meetings, DUI classes, and three years of probation. In addition to dealing with all of that, your auto insurance will be affected because you’ll be considered a “high risk driver.”

Beyond the above consequences, you’ll be living in the shadow of your DUI for years to come. For starters, the DUI will remain on your DMV record for the next 10 years. That means that if you get another DUI within 10 years, your original DUI will be treated as a “prior” offense and you will face enhanced penalties for any subsequent DUI.

What about my criminal record?

While a DUI drops off your driving record after 10 years that is NOT the case with your criminal record. Since California treats DUIs as serious crimes, any third-party background check ran by a prospective employer will turn up any DUI convictions, regardless of how long it’s been. DUIs stay on criminal records indefinitely.

Your future employer may care whether that DUI was merely an arrest or if it was a conviction.

If you were arrested for DUI but you hired a good defense attorney who got the DUI charge dismissed, then your record will indicate that the charge was dropped, and this can make a huge difference in whether you land a job or not.

Fighting Your DUI Charges

Depending on the industry that you are in, a DUI conviction can be a career death sentence, especially if you drive a commercial vehicle for a living, you drive clients around, or you work in a profession that requires a professional license.

Many licensing authorities will deny or revoke a professional license if a person is convicted of a crime, including DUI. A DUI can damage a career in education, medicine, the trucking industry and in many other professions, so it is definitely worth fighting.

If you’re concerned about having a DUI show up on your criminal background check and negatively affecting your employment opportunities, your best bet is to fight your DUI charges in an effort to avoid a conviction in the first place.

To fight your charges, contact the Law Offices of Virginia L. Landry, Inc. to work with one of Orange County’s top DUI defense firms – home of the DUI Queen!
