Will I Get Fired Because of My DUI?

When people are arrested for driving under the influence, naturally they’re going to worry about how that DUI arrest is going to affect things like their job and their auto insurance premiums.

Let’s say that you were arrested for DUI a few months ago, and you’re currently working for the county. Now, you’re wondering if your DUI will affect your current job. Fortunately, you have a desk job, and you are not required to drive to different locations as a part of your duties.

Does your employer make a habit of routinely checking employee backgrounds and court filings for DUI? Probably not. It’s doubtful that your employer will find out about the DUI unless you specifically tell them about it.

We have found that most, but not all, employers do not punish employees who have been arrested for DUI during off work hours.

California is an At-Will Employment State

Keep in mind that California is an “at-will” employment state, which means that an employer can fire an employee for any reason as long as it’s not based on discrimination, for example, because of someone’s race, sexual orientation, or religion.

So, if you happen to work in a field where your image is an issue, then the DUI could pose problems. For example, if you teach high school students, or you’re in politics, or you’re a probation officer, or you’re a family physician, your employer may feel that the DUI is just bad for business.

If you’re out of the limelight, and your job duties do not involve driving, the DUI should not affect your job. However, it’s impossible for us to give an accurate prediction since each employer is different. In our experience, employers are more inclined to do something when their employee’s job involves driving.
