Expunging 2 DUIs in California

So, you’ve received two DUIs in California. You’re now completely off probation and are interested in expunging the two DUIs. Not a bad idea, especially if you’re in school and planning on obtaining a professional license, or you want to work in a field that would frown upon your DUI convictions, even if they aren’t terribly recent.

You understand already that expunging your DUIs won’t remove them from your criminal record, but you are smart enough to know that doing so would show good faith when taking the test for your professional license, or when applying for that dream job after you get your master’s degree.

As Orange County DUI attorneys, what advice would we give someone in this position?

Clearing the Wreckage of Your Past

You paid your dues and now you want to move on with your life. Is it possible to get not one, but two DUIs expunged? Yes, it is possible; California Penal Code Sec. 1203.4 governs expungements in the Golden State.

If you want to clear the wreckage from your past and move on with your life, the best thing for you to do is contact a DUI lawyer, such as Virginia L. Landry, who has experience handling these types of cases.

We can guide you through the process so you’ll have a better chance of having your motion granted.

Expunging your DUIs has its advantages: It shows good faith to licensing boards and future employers that you have changed your ways and are not the same person that was convicted of two DUIs. If this is important to you, you really need to hire an experienced lawyer to file a proper motion on your behalf.

No Such Thing as a ‘True Expungement’ in CA

There is no “true expungement” in California. Most attorneys refer to a dismissal pursuant to Penal Code 1203.4 as an “expungement,” which is discretionary in DUI cases. That said, you need a good attorney if you want the best chances of getting your DUIs dismissed.

If you successfully get your dismissals, when you take the test and apply for licensing, be sure to disclose the DUIs, even if they were expunged because the state licensing boards will see the convictions anyway. Despite the DUIs on your record, you have a better chance of getting licensed if you are honest about the convictions and expungements.
