Woman Convicted of DUI Manslaughter Faces Second DUI

A Virginia woman that served over two years in prison for a drunk driving accident that left a construction worker dead has again been arrested for DUI. In the 2008 crash, she was found guilty of aggravated involuntary manslaughter and DUI after her vehicle caused a chain reaction car crash. On top of the prison time, she received an additional six and a half years of suspended prison time, lifetime license revocation and seven years of probation.

New DUI Charges After a Felony DUI

The woman was pulled over on a Tuesday afternoon after other drivers had called authorities about a reckless driver. Officers at the scene reported that the driver crossed over the center line and came close to hitting another vehicle head on.

After being stopped by police, the woman fell getting out of her vehicle and was unable to complete a field sobriety test and reportedly smelled of alcohol. An hour later, a blood alcohol test registered her BAC at .25, over three times the legal limit. The woman is charged with a Class 6 felony as a result of this last arrest. If convicted, she faces a five year prison sentence.

This case helps illustrate situations where motorists who have been previously convicted of a serious felony DUI offense are arrested for new DUI charges. In California, drivers who have a felony DUI conviction on their record for any reason can potentially face felony charges when arrested for a new DUI at any time and for any reason.
