First Time DUI Offenders May Receive Lesser Penalties in Miami

A new program being offered by the Miami-Dade State's Attorney office will give some first-offender drunk drivers a chance to reduce their charges.

Referred to as the "Back on Track" program, will allow some drivers to reduce their DUI charges by seeking treatment, paying fines and completing alcohol education classes. However, the new program is already meeting resistance from groups like Mothers Against Drunk Driving (MADD) even though it has yet to be officially offered.

The program will only be offered to those DUI offenders who were not involved in a car accident, did not commit another crime at that time, and there were no children present at the time of the DUI arrest. In addition, the individual must have a valid drivers license and have a relatively clean past driving history. Those who are deemed eligible must sign up for classes through the Advocate Program or Court Options, as well as pay fines ranging from $2,000 to $3,000.
