You California DMV Hearing

If you have been arrested for a DUI recently, you might be wondering how the DMV hearing differs from the court trial for your offense.

In the case of the DMV hearing, this is simply an administrative meeting that will determine your driving privileges. They will focus on the circumstances surrounding your arrest, but will not determine whether you are guilty or not. What will be discussed instead is whether you took a blood or breath test, whether the officer had reasonable cause to pull you over for drunk driving, if your blood-alcohol level was over 0.08, and were you placed under lawful arrest.

You will be asked whether you were informed of your rights, as well as what would happen should you refuse the blood or breath test. In the state of California, for example, if you refuse these tests then your driving privileges would be suspended for one year, or revoked for two to three years.

Don't attend your DMV hearing alone; contact our law firm to get assistance from an Orange County DUI lawyer today.
